It's funny that you should say that. When I found the story, I noticed that the case was thrown out of court on a motion to dismiss. I'm not sure if you're aware of exactly what that is. It's a motion that's usually, but not always, made by the defense at the very beginning of a lawsuit when the defense believes a number of requirements for the lawsuit to proceed have not been met. So, if the motion to dismiss is granted, the plaintiff has failed to meet the minimum requirements for the lawsuit to proceed.
