maybe you should check your own lane

did you happen to notice

the words "pre trial "

he waived a pre trial motion

he reserved his right for a future time

You are correct.

What people ignore though, is that even if Zimmerman is not entitled to stand your ground immunity, he is still entitled to use self-defense.

yes

SYG is a side issue of self defense

it was not is not appropriate for this case

SYG means you had the chance to retreat and did not

the defense claims that zimmerman did not have that chance

making it a pure self defense case

immunity is yet another issue and is not related to SYG

it is attached to self defense

which would be present in both a classic self defense case

or

a stand your ground case

however zimmerman still holds his right

to an immunity hearing

if he needs one

Lane checked.

Zim is pleading lawful self-defense of a forcible felony not "Stand your Ground"

SYG is the only oppty for immunity.

yes

however immunity is not related only to STG

And there is no self-defense immunity....it requires a trial.

That's why he is having a trial. A trial in which the prosecution is proving up the defense case for them.

and if zimmerman wins that case

or the judge throws it out

after the state rests

zimmerman can still have an immunity hearing

No worries.

the defense only waived pre trial immunity

O'Mara told Nelson there was nothing in the law that required the immunity hearing to occur before Zimmerman's trial and could be requested after prosecutors presented their case.

which they will do

An SYG hearing is for pre-trial immunity.

you are confusing the issue

zimmerman still has a right to an immunity hearing

if he wins his case

or if the judge throws it out

for lack of evidence

Knowing what you know today, what do you believe will be the outcome of the trial.

THIS IS NOT A ZIMMERMAN TRIAL DISCUSSION THREAD.

Please only discussions pertaining to the poll in this thread.

acquitted.

There was an increase in burgleries in his area, so he followed a stranger to make sure he left the area.

that person attacked him

he responded by pulling his gun and shooting from the ground

Unless someone thinks a teen is badassed enough to jump a man holding a gun

If by some miracle, this all white jury ignores the facts and acquits this slug, Federal charges will follow.

I'm just hoping their aren't race riots between the two cases.

That's not going to happen Joe.

The FBI investigation found NO EVIDENCE that the shooting of Martin was racially motivated.

The investigation is closed.

Arrested and claim SYG = Seek Immunity hearing from trial - Judge decides in hearing which defense must prove SYG

Arrested and claim self-defense = Trial by Jury which prosecution must prove charge. (Can still call for Judge to decide instead of jury after prosecution presents)

Prevail in either = immunity from criminal prosecution and civil action.

Nope again. Statutes give him automatic immunity from civil liability if he prevails criminally.
