Most recently, military investigators found that nearly one in three court-martialed convictions that should have prevented defendants from purchasing guns had gone unreported.

NICS reporting is required for all federal agencies, including the military, and include regular mandatory compliance reports. The federal law was strengthened following the 2007 mass shooting at Virginia Tech.

Considering that BCD and Dishonorable discharges are pretty rare in the military (over 20 years in the Navy, I only saw 2 people get a BCD and never saw a dishonorable discharge, and I was the one that did the paperwork for the command), you would think that they would take the time to do the proper reporting. It's not like every discharge has to be reported, just the ones like BCD and Dishonorable, and it ain't easy to get either. You have to really screw up bad.
 
The Va. Tech shooting happened because liberals in the Va. government thought a psychiatric patient's right to confidentiality was more important than the safety of citizens. The Va. Tech shooter was a Korean born legal resident and was apparently suffering from severe psychiatric problems and the staff and students were terrified of him. When female students reported being stalked by him the local police avoided placing him under arrest and instead a local court ordered psychiatric counseling which he apparently never attended. Either the school or the local police failed to report the court ordered counseling or the state failed to note it but either way it never appeared on the instant name check and the (legal) alien who was clearly insane, slipped through the judicial cracks and was able to purchase several firearms. It seems that the same concerned citizens who worry about court martial offenses being reported to NCIC seem to be O.K. with Veterans who claim PTSD mental disorder (with all it's violent ramifications) to such a degree that they receive a Military pension and yet are able to purchase a firearm.
