Alabama judge allows teenage would-be dad to sue medics on behalf of his aborted fetus in a potentially groundbreaking right to life case

· Ryan Magers, 19, filed a lawsuit Tuesday against the Alabama Women's Center for Reproductive Alternatives in Huntsville, Alabama

· Magers listed the unborn child he conceived with his girlfriend as a plaintiff

· Madison County Probate Judge Frank Barger ruled that the unborn child that Magers calls 'Baby Roe' can be named as a co-plaintiff in the lawsuit because of the passage of a November ballot initiative, known as Amendment 2

· Amendment 2 added a clause to the state's constitution recognizing that life begins at conception
