If the Senate is not recessed and they give a damn that Obama made an appointment without their consent, why haven't they passed a single measure saying so?If the Senate was in recess, why is only ONE Democratic senator saying so? Even Harry Reid refuses to say if the Senate was in or out of session when the appointments were made.
Because Senate Repubs know that if they push the issue they're likely gonna have to answer for their own part in this.
Sounds like consent to me.
Sorry, but if a legislative body is supposed to give consent for something whenever they are around to do so - and the executive does something without their express consent - and that legislative body does nothing about it - they are giving implied consent.
I would further point out that if the President is indeed making an appointment while the Senate is not recessed - the Senate itself is the damaged party, and if they fail to speak up on their own behalf, the issue is de-facto settled.
