You do realize that the 1023 was presented to the Trump administration's AG, not Biden's, and it was the Trump administration that found nothing there. Cruz is doing what he does best, showboating. I agree. It's insanely low from a US senator who is also a lawyer to pretend he isn't aware that as a general rule the FBI or DOJ doesn't publicly comment on ongoing investigations. That he uses a practice designed to protect the rights of any person not to mention the very real treat of being unable to prosecute as a way to suggest that the FBI is being "weaponized"
There is nothing under Law to prevent the FBI from talking about any case. They do it all the time via leaks to a quiescent press.

A 1023 is raw data, a claim from a source being written down. It makes no judgement on the validity of the claim.
We already know Trump turned DoJ into his personal enforcement gang, and that he told Barr to collect made-up 1023 info from Guiliani. And boy howdy, did the conservatives here all love that politicization of law enforcement. They still do. After all, not one of them has any regrets over supporting Trump and Barr and Guiliani doing that.
The FBI reviews the 1023s and makes a judgement. In this case, they concluded the story was a big steaming pile. The Trump cultists, being devoted servants of the Lord of Lies, always leave that part out. Instead, they tell the BigLie that if it exists on a 1023, it must be true.
