Donald Trump’s legal team is set to use a previously undisclosed “conflict of interest” as grounds for appealing a recent verdict that orders the former president to pay advice columnist E. Jean Carroll $83.3 million. Trump attorney Alina Habba told the New York Post she was previously unaware that Manhattan federal Judge Lewis Kaplan, who presided over the case, worked with Roberta Kaplan, Carroll’s attorney, at the Paul Weiss Rifkin, Wharton & Garrison law firm in the early 1990s.

Habba says neither the judge nor Roberta Kaplan revealed this professional history. “It was never disclosed. It’s insane and so incestuous,” Habba said, asserting the non-disclosure counts as an ethics violation. Early in her career, Roberta worked as an associate at the firm during the same period as Judge Kaplan, who was a partner until his 1994 appointment to the federal bench by then-President Bill Clinton.

A representative for Roberta Kaplan, Zak Sawyer, said no conflict of interest exists because Roberta never worked directly for Kaplan, a defense undermined by an unnamed ex-partner at the firm, who told the Post, “Lew [Lewis Kaplan] was like her mentor.”




 
That argument will go nowhere. There are over 1000 lawyers in that firm. The fact that a lawyer and judge were members of the same firm, does not mean the judge need disqualify himself. Besides, this was no secret. Any idiot can quickly check the resumes of Robin Kaplan and Judge Kaplan and see they were at the same firm for a short time. At any rate, this is just another f-up on the part of Trump’s lawyers. They should have filed a motion to disqualify the judge during the first trial if it was such a concern. They are bringing it up now because their grounds for appeal are so slim.

Is there a single case against Trump where it doesn't turn out to be a HUGE conflict of interest or illegal conflicted deal with the DA, prosecutor or judge?

What are the odds?

Worse, money is just pouring in to help finance these cases against Trump; I think Willis has gotten something like 10X the usual money collected. Makes you realize that the US justice system is as crooked as everything else in government.

From what I have read, the two barely knew each other at the law firm. Acquaintances at best. To be honest with you, the very first thing any lawyer worth a damn would have done is check into the relationship between the two Kaplans. They have the same surname for heaven’s sake. I don’t believe for an instant that Trump or his lawyers did not know of the law firm connection. They held it in their back pocket for appeal purposes. The appellate court will see right through that little shenanigan.

Adding to the controversy, it was revealed that Shawn Crowley, one of Carroll’s lead counsels, is reported to have served previously as a law clerk for Judge Kaplan. Furthermore, it has been disclosed that the judge co-officiated Crowley’s wedding.

“This issue is particularly concerning since Plaintiff’s other lead counsel, Shawn Crowley, served as Your Honor’s law clerk, and we were previously advised that Your Honor co-officiated her wedding,” said Habba.
