Here's how conservatives on the Supreme Court plan to attack civil rights
With the new make up of the Supreme Court on the near horizon -- Trump has a chance to appoint a solid strict constitutionalist who will NOT be a swing vote for libs.
So what rulings or laws would you like to see overturned as being unconstitutional?
My biggest one is the sacred Civil Rights Act --- I believe it should be overturned or at least seriously gutted -- and I believe we may get to see that happen very soon if they can get rid of just this one provision “disparate impact” --- from the article:
The key here is that a practice doesn’t have to intentionally discriminate, but if the impact primarily falls on those belonging to a protected class, it warrants investigation. That has been the yardstick for measuring discrimination for over forty years now. One can imagine that if a plaintiff had to prove intent to discriminate, almost no provision in the civil rights laws would ever be enforced.
When you have these Black Activist-LGBT agitator types who wants to cry discrimination about everything -- when you force them to prove intent to discriminate, they will most definitely fail to do so -- therefore making the Civil Rights Act irrelevant. This will give companies and landowners the freedom to do as they wish with their property or business without having the fear of the government coming down on them.
If someone wants to discriminate based on race or religion, they should be free to do so if the person who feels they have been discriminated against can't prove their intent -- if you just happen to belong to a group that gets discriminated against the most, maybe that says more about you than the one who is discriminating against you.
