Why Is Anyone Willing To Believe Stormy Daniels?

I would think the contract should spell out the consequences, but we don't have it available, so we'll see.
Basically, Michael Cohen took out a second mortgage to quickly pay off Stormy Daniels to keep her quiet and paid her through some shell corp, rushed after the Access Hollywood tape came to light...

His Presidential candidacy could not withstand being hurt if the Stormy affair came out too, on the heels of him already defending the Access Hollywood tape as just Locker Room Talk. So Trump decided to pay her off in exchange for a Non Disclosure Agreement.

Well, the main issue that I am aware of besides some of the technical Campaign financing issues is that when the trump org paid Cohen back and paid him his fee for doing all this hush money work, including him taking a second mortgage, and paying the other $100 grand to silence Karen McDougal through a catch and kill at the National Enquirer as well...

the Trump Org illegally reimbursed him $500,000 as some business expense for a new audio system and equipment....avoiding Michael's income earnings being taxed, and allowing trump org to illegally write it all off as a business equipment expense on their taxes.

Cohen spent some of his time in prison for this crime already....

Because she's being celebrated as another tool that will finally "get" TRUMP!, because she broke a contract. Should she not be held accountable to the contract she signed and for the money she accepted?

Trump’s former fixer said President Trump himself had directed him to commit the crime in the lead-up to the 2016 election, which worsened Trump’s legal troubles in a variety of ways. Over the weekend, Trump’s legal team tried to resolve at least one of those matters by releasing Daniels from what has already proven to be a wildly unsuccessful non-disclosure agreement.

On Friday, a lawyer for Essential Consultants, the company Cohen set up to pay Daniels, sought to void the agreement in a legal filing, and to recoup the $130,000 payment. (Trump reimbursed Cohen for the $130,000, and it’s unclear who would get the money if Daniels returned it.)


“Today, Essential Consultants LLC and Michael Cohen have effectively put an end to the lawsuits filed against them by Stephanie Clifford, aka Stormy Daniels,” Brent Blakely, Cohen’s lawyer, told CNN. “The rescission of the Confidential Settlement Agreement will result in Ms. Clifford returning to Essential Consultants the $130,000 she received in consideration, as required by California law.”

On Saturday, Trump’s attorney Charles Harder said in a separate court filing that the president would not seek to enforce the agreement, and would not contest Daniels’s “assertion that the Settlement Agreement was never formed, or in the alternative, should be rescinded.” Harder called on Daniels to “immediately dismiss” Trump from her lawsuit.

Trump’s legal team had initially tried to force Daniels into an arbitration that could have required her to pay the president more than $20 million for breaking her silence over their alleged 2006 affair, which Trump has denied. Daniels sued Trump in an effort to void her NDA, arguing that the agreement was invalid because Trump never signed it, or possibly because its purpose was illegal.

Daniels’s case had been put on hold pending the outcome of the federal investigation into Cohen in New York; following his guilty plea, Daniels’s attorney Michael Avenatti said they would move forward with efforts to make Trump give a deposition in the case. Daniels is also suing Trump for defamation for suggesting she was lying about being threatened to keep quiet about the affair.

I don't think she ever paid the $130K back. She also was ordered to pay Trump more than $500K in legal fees on her defamation suits.

"The 9th US Circuit Court of Appeals sided with Trump in his effort to recoup additional legal fees from adult film star Stormy Daniels, who had filed and lost a defamation suit against the former president.

Daniels was ordered to pay Trump’s attorneys just over $120,000 in legal fees. That’s on top of the over $500,000 in court-ordered payments to Trump attorneys she’s already been ordered to pay."

 
Well, speaking of the Porn Queen and adultery-partner with Don Trump----the now famous Stormy Daniels, well, we may see her on the witness stand in the foreseeable future. And maybe another adultery partner, Karen McDougal. Not to mention, the facilitator and bagman for getting those two women to keep their mouths shut over their affairs with the married Don Trump.....so as not to harm his candidacy.

Anyway, this afternoon's NYT has reportage on what to expect next week. As this trial is right in the Times' backyard (and lotsa other media too)....we can expect wall-to-wall coverage. Here is the piece, I've truncated it a fair amount to keep its' length manageable on a social media site:

"Starting on Monday, I’ll be part of the Times team of reporters covering the first criminal trial of a former American president. It will unfold in a dingy courthouse just blocks from New York’s City Hall, and we’ll be there for every twist and turn.

It should be a doozy, complete with hush money, a porn star and a fuming defendant. And oh, yes, it could test the resilience of our legal institutions and the concept that no individual is above the law.

Donald Trump’s trial is the culmination of a case that has been hotly contested since it was unveiled last spring. After months of legal machinations, including three long-shot appeal attempts this week, it seems to be on track to actually begin: Jury selection is scheduled to start on Monday. Testimony is expected to last weeks, amid a level of media scrutiny that some have likened to the O.J. Simpson trial nearly three decades ago.

This is no murder trial, but it still has sensational elements: Trump faces 34 felony counts of falsifying business records to try to hide a sexual encounter he is alleged to have had with Stormy Daniels, a porn star he met in 2006. The former president denies the charges and having had sex with her.

Prosecutors could call Daniels and a former Playboy model, Karen McDougal, who said she had an affair with Trump, as well as Michael Cohen, Trump’s former fixer, who made the payment to Daniels just before the 2016 election.

These witnesses and testimony are likely to produce days of popcorn-worthy coverage — though, as with many trials dealing with financial matters, there may be a few sleepy sessions, too.

What to expect

Here’s how the trial is likely to unfold:

  • Day 1: Several hundred jurors are expected to be called in on Monday to potentially serve, a critical vetting period known as voir dire. Both prosecution and defense teams will be trying to sniff out hidden biases, with the help of a detailed juror questionnaire. It could be a grueling multiday, or even multiweek, process.
  • Trump, who claims to be displeased by a trial that he feels is profoundly unfair, could be in court four days a week — Wednesdays are off days. The judge, Justice Juan Merchan, has issued a gag order barring the former president from attacking prosecutors, witnesses, court staff and the judge’s own family members, after a series of angry posts on Trump’s Truth Social account and elsewhere.
  • The trial won’t be televised, but reporters will be able to post updates directly from the courtroom and a nearby overflow room. Expect a lot of focus on Trump’s demeanor and the interaction between his legal team and Merchan, who has kept the defense on a short leash so far.
The 34 counts are all Class E felonies, the lowest category of felonies in New York state. Trump’s lawyers will be hoping for an acquittal or for a holdout juror, which could lead to a mistrial. If the former president is found guilty, each count carries a maximum prison sentence of four years.

The Manhattan proceeding may be Trump’s only trial before the election. Two federal cases, as well as another state case in Georgia, could all be pushed back until after voters decide whether to once again elect Trump — or re-elect President Biden — in November.
