It doesn't matter who or how many people agree with it, ultimately, it depends on what a court decides. The concept is debatable. That's what everyone is doing now. My belief is that it depends on "intent." If the investigation wants to pursue intent, it will have to prove its case in court.

Law professors are teachers. They teach what and how the university or college dictates because the school picks up their check. They are a collection of facts about a subject and are paid to teach them to others, not paid for the veracity of their legal OPINION. Alan retired as a formal law professor 5 years ago, Jackass. Now he makes his living in the private sector like the rest of us giving us his honest legal opinions free of corrosive influences.
