The right thing would have been to send contested elections back to the states to be investigated. It would be in those legislatures hands, not Pence's.

Ashli Babbitt $30 Million Wrongful Death Suit Hearing Set for August 6

Judicial Watch, a nonprofit American conservative activist group, announced Monday that a hearing has been set for Tuesday, August 6, in the Ashli Babbitt $30 million wrongful death suit filed on behalf of her estate. Babbit was shot and killed by a Capitol Police officer during the Jan. 6 protests.

Judicial Watch posted to Twitter/X Monday and said Babbitt and her family “deserve accountability and justice”:

The group and its president, Tom Fitton, wrote on their website about the filing and said the federal government was guilty of negligence, assault and battery, and more:

There was no reason for Babbitt to die that day. She was unarmed except for a folding knife that was in her pocket and was not attacking or threatening anyone at the time she was shot. It will be interesting to see if anyone, including the shooter, Capitol Police Lieutenant Michael Byrd, will ever be held accountable, or if this administration and the legal system will continue to pretend like it never happened.

The Left used to be outraged about protesters being shot.

They investigated themselves and then they denied that there was any wrongdoing.
They should have never been allowed to investigate themselves.

When engaged in lawful protected first amendment protest, there are still several things that can go wrong:

1. You could get trampled by the group if gunfire goes off or some other events causes a panic and stampede
2. You can be mistaken by the police for a criminal if, like in the case of the Black Lives Matter protests, opportunists use the lawful event as cover for criminal activity such as arson, looting, etc. and as a result be
   a. Arrested
   b. Shot/killed
3. You could be harmed as a result of physical assault or shooting by counter-protestors
4. If you get arrested and end up with an arrest record and/or conviction, that could negatively impact current and/or future employment as well as professional licensure

If you engage in unlawful protest activities such as threats, violence and attempts to prevent the U.S. government from completing a U.S. Constitutionally mandated function, the certification of the 2020 election results, then all of the same undesirable results that can occur when engaging in lawful protest can occur, plus more.

Destruction of property is not constitutionally protected activity. Neither is threatening the lives of the police officers who were there attempting to protect the lives of all of the government workers and congressional members who were in various location of the Capitol at the time.

I posted a video showing what prompted the mob to take the action that they did at that time, they were agitated by the thought that the congressional members were "getting away" (you can clearly hear in the video "they're leaving, they're GETTING AWAY").

The family will probably get something as a result of their filing but the threshold to prevail in a civil lawsuit it only 51%, a preponderance of the evidence. I still believe that Officer Byrd acted correctly and the gender and race of the perpetrator (Babbett) had no bearing on his actions, ANYWAY attempting to come through that window, would have (and should have) received the same fate.

Babbit's family has a right to sue, and most likely it will be dismissed.

The judge has already allowed four of the seven counts to go forward. Dismissal would have already happened.
