Battery?? Why not attempted murder??

They expelled the kid and will charge him with battery. Um. No. He tried to KILL that kid. And the school didn't even call an ambulance after the nose was knocked clear across his face. They called his dad to come get him.

That family needs to sue the shit out that school and pressure the DA to go for attempted murder charges.
 
You can prove beyond reasonable doubt that if you punch someone in the face you are not trying to kill them. That's how the law works, charge him with attempted murder and he will get off, charge him with battery and he wont.
 
Hes being charged as a juvenile unfortunately. I think an attack like that deserve severe punishment.

You could also charge him with both and see what happens.
 
That's not battery - It's called assault and with that much damage - felony assault.

Edit: The student was actually charged with aggravated battery; a felony under GA law.

It's just the wording - no, It's not attempted murder, but this other child will probably be charged as an adult under GA law.

The school in this case, is guilty of extreme negligence. This lawsuit will be settled out of court for big money.
