Under federal law your money can be "arrested" even if you aren't convicted of any crime.

The burden of proof is on the person who's assets are seized to show they were not gained through criminal activity.

It isn't seized for evidence in these cases, there's no arrest, no charge, no probable cause or even reasonable suspicion of the individuals committing a crime.
