There’s another aspect to the question.

If a sitting president is subject to criminal indictment once he leaves office, it could hamstring that president’s decision-making process, particularly with regard to foreign policy.

He might not act against a potential national security threat, for example, such as unilaterally killing a US citizen in a foreign country planning a terrorist attack against America, if he believes he’ll be prosecuted for it as a private citizen.

And there's the fundamental tenet of our democratic institutions that we don’t subject political opponents to criminal prosecution; that’s what made Trump’s call to ‘lock up’ Clinton so wrong and reprehensible.
