I'll help you out. The Feds say you can't forbid someone from sending or receiving information as the the color of my underpants. Great, good so far. And then the state of _____ passes a law that says local police cannot ask about the color of my underpants. Since the police cannot ask, and the Feds don't know, no laws are broken and the color of my underpants is my concern, only.

By law, they can be forbidden to ask. By law, they cannot be forbidden to tell or to be told. If they are forbidden to ask, not forbidden to tell or be told, no laws have been broken. Learn the fucking law.
 
For those who don't get this, the Feds say, you cannot be forbidden from telling us Subject A has a gun or from us telling you Subject A has a gun. By law we have to be able to discuss whether or not Subject A does or does not not have a gun. Good so far? Then along comes NRAville which passes a law that says, Local Authorities are not allowed to ask subjects of NRAville if they have guns or not. Said law being passed, when Officer Friendly stops you for jaywalking he has no knowledge of whether or not you have a gun because he's not allowed to ask, so therefore there is nothing to report to the Feds, meaning no law is broken.

It's not that you have a gun and he can't say so, or you don't have a gun and he can't say so, he does not know because he's not allowed to ask in the first place, which isn't against the law.

This is not ask and don't tell, this is do not ask, which is perfectly legal.

Look old friend, if the Sheriff's policy is out of line then it needs to be adjusted. The SF law as it stands is not against the law. If the difference between being forbidden to ask, not forbidden to discuss someone's status with the Feds, and the Feds had this guy in prison and didn't deport him. Save your vitriol for the Feds, they are responsible for deportations not San Fransisco.

We do not (yet) have every Barney Fife stopping the wetbacks on the street to ask for their papers. That is not the law, and the laws that sanctuary cities have created are legal, like it or not. You might believe they are breaking the Federal laws, as if you give a damn about obeying the Feds, but they are not. This is a Federal issue, not a state or local issue. They had the guy in prison right before this and didn't deport him. And next time, use a real source and read up first.

"The grievance by the San Francisco Deputy Sheriffs' Assn. challenges Mirkarimi's March 13 department-wide memo that called for "limited contact and communication with ICE representatives absent a court-issued warrant, a signed court order, or other legal requirement authorizing ICE access."

The memo then details which information can and cannot be shared without a court order.

Mirkarimi's directive went a step further than the city's 2013 Due Process for All ordinance, which bars jail officials from honoring ICE requests that inmates be held beyond their release dates for pickup unless the inmate faced court action on a violent felony charge and was convicted of a similar crime in the past seven years.

He issued the memo as departments across the state and nation also implemented policies barring the honoring of detainers absent a judicial warrant. ICE has said it cannot obtain such probable cause warrants because there is not a process readily available for such a purpose.

The crackdown on cooperation with ICE came after federal courts last year deemed the detainers unconstitutional absent some kind of judicial review."
