Officers found Green unresponsive on a road near the home, police say. They performed CPR, but Green died at the hospital from "an apparent single gunshot wound to his back," Sanford Police Chief Cecil Smith said at a news conference.

Evidence at the scene shows Green tried to break into one of the homeowner's vehicles, Smith said.

The homeowner wasn't arrested because he was justified in using deadly force when Green allegedly engaged in a "forcible felony," said Assistant State Attorney Dan Faggard with the 18th Judicial Circuit.

The homeowner told police he feared for his life and for the lives of his wife and baby, Faggard said. Authorities have not publicly identified the homeowner.

Under Florida law, a person can use deadly force if she or he "believes that such conduct is necessary to prevent the imminent commission of a forcible felony."

The person using deadly force "does not have a duty to retreat and has the right to stand his or her ground if the person using or threatening to use the deadly force is not engaged in a criminal activity and is in a place where he or she has a right to be," the law states.

O'Mara contested the prosecutor's claim, saying the homeowner says in the 911 call that he fired his weapon to scare Green off of his property.

"They weren't shooting in fear of personal safety," O'Mara told CNN. "In this case, it's pretty clear, in my opinion, you aren't allowed to shoot someone because they are breaking into your car."

The investigation is ongoing, State Attorney Phil Archer's office said in a statement, and once a final determination is made it will be announced publicly.

Florida's stand your ground law was a topic of debate in the Zimmerman case, as well as in the cases of Michael Dunn, who killed Jordan Davis, 17, during a 2012 argument over loud music in Jacksonville, and Michael Drejka, who killed Markeis McGlockton after McGlockton pushed him in a 2018 confrontation over a handicapped parking space in Clearwater.

Like Zimmerman, Dunn forewent a stand your ground defense and argued the shooting was in self-defense. Dunn was convicted of murder, Drejka of manslaughter. Both are in prison.

The main contributing factor to the high rate of black crime is well known and has been posted many times.....most black kids have dysfunctional homes....no father present....their mother getting pregnant by different men and unable to control her children as they get older....thus they run the streets at all hours committing all sorts of crimes and as the older they get the more serious the nature of their crime becomes....the net result is our prisons are overwhelmed by black inmates of which neither blacks or liberals will admit they shoud be in jail...they claim in fact that the laws these criminals break are unjust or that the criminal justice system discriminates....thus denying the problem.

This very lame at best and thus these folk that do that are not part of the solution but part of the problem.

Any problem that society has can never be solved unless the problem is recognized.....thus far...the democratic party, liberals, most blacks and other misguided folk refuse to face up to the real problem.....black families are broken...single mothers having loads of children and unable to control them needs to be dealt with....giving them more welfare is the answer...money is not the answer....the answer is to re-establish the foundations for a functional black family....i.e. black families with a father present....that is why black muslims have considerable influence in black communities....they preach high morals and sound families.

Black Christian pastors are inadequate....they need to preach the truth and stop all the nonsense they preach regarding social justice....they need to recognize that what they preach for the most part is fallacious...they need to get back to the basics....that they at one time did preach and when they did the black families were much stronger and the rate of black crime was very low.....no reason that they cannot re-establish the morals they had at that time....yes it is a question of morals....practicing good morals and living to the standards of True Christianity....otherwise the muslims will continue to advance and Christianity in the ghettoes will continue to decline.

If your instructors are teaching you to try and disarm someone who's holding a gun on you then they need to find another line of work! My instructor was Larry Kelly, one of the best Karate fighters in the country back then. He didn't teach his students to be morons. Karate doesn't make you bullet proof. If someone pulls a gun on you...the only sane response is to be non confrontational. Please don't tell people they need to resist someone with a weapon. It's foolhardy and will get people hurt needlessly!

You are very confused about the Zimmerman case. It was not a stand your ground case though many have that misconception.

It was a simple case of self-defense. Travon attacked Zimmerman....ambushed him...after initially running away he came back and attacked Z....thus placing Z in fear of his life...thus he was entitled to use lethal force to save his life....which he did.

The jury agreed....and justifiably so....even Jimmy Carter one of the most Liberal people in America...agreed.

The problem with the Z case as others when the media gets involved...the people are not told the truth....the media twists and spins these cases in an attempt to incite the black community as well as gullible white liberals into something it never was.

First of all they presented a picture for the world to see of Trayvon when he was about ten years old.....most people thought this is the way he really looked on the night he was killed....thus people became angry thinking this sweet looking little black boy was killed for no reason.....however the little boy had grown up....he was no longer just 10 yrs old....he was within days of being 18 and had become a wanna be gangsta.

But even obama was tricked by the photo...provoking him declare if I had a son he would look like Trayvon....thus inserting himself and his authority into a criminal case prejudicing folks against Z...this was outrageous and should never have occurred.

Fortunately Z had a good defense team and they were able to get an honest jury who looked at all the evidence and facts of the case which most of these folks who still want to argue this case....do not have and never had. Very few of them that come on here in defense of trayvon know the facts of the case.

I really did not want to go in this direction but some of the posts above have provoked me because it is easy thus to see even some conservatives really do not have a good conception of how pervasive black crime is.....they want to make too many allowances for black suspects an--d black criminals.....that is a huge reason there is so much black on white crime not even to mention black on black crime which is also taboo to talk about.

There is a pathology in the black community that really needs addressing....the break-up of the black family, why so many young blacks turn to crime,violence and drugs....very disproportionate to their percentage of the total population.

The person using deadly force "does not have a duty to retreat and has the right to stand his or her ground if the person using or threatening to use the deadly force is not engaged in a criminal activity and is in a place where he or she has a right to be," the law states.

O'Mara contested the prosecutor's claim, saying the homeowner says in the 911 call that he fired his weapon to scare Green off of his property.

"They weren't shooting in fear of personal safety," O'Mara told CNN. "In this case, it's pretty clear, in my opinion, you aren't allowed to shoot someone because they are breaking into your car."

The investigation is ongoing, State Attorney Phil Archer's office said in a statement, and once a final determination is made it will be announced publicly.

Florida's stand your ground law was a topic of debate in the Zimmerman case, as well as in the cases of Michael Dunn, who killed Jordan Davis, 17, during a 2012 argument over loud music in Jacksonville, and Michael Drejka, who killed Markeis McGlockton after McGlockton pushed him in a 2018 confrontation over a handicapped parking space in Clearwater.

Like Zimmerman, Dunn forewent a stand your ground defense and argued the shooting was in self-defense. Dunn was convicted of murder, Drejka of manslaughter. Both are in prison.

Yes, but we are expected to stand down when thugs threaten or rob us. This is the progressive way.

Thus they encourage crime....they want to give criminals more rights than their victims.
