A drivers license should not be a proof of citizenship, it should be a proof of your driving ability
States all set various requirements for obtaining a driver's license. You can be suspended for failing to pay property tax on your vehicle, for being behind on child support. Why can they not deny a license to someone who has entered the country illegally?

She has lost one court decision after another.

On Wednesday, less than three weeks before she leaves office, Brewer was dealt another defeat when the U.S. Supreme Court cleared the way for "dreamers" to get licenses.

The court denied Brewer's request for a delay that would have allowed her to keep denying licenses to dreamers while she prepares an appeal to the justices.

Within hours of the Supreme Court's decision, the 9th U.S. Circuit Court of Appeals instructed U.S. District Judge David Campbell to issue a preliminary injunction blocking Brewer's driver's-license ban.

All persons in the United States are entitled to equal protection of the law, including state laws that regulate the issuing of a driver's license. Because those undocumented are not 'illegal' until found guilty in a court of law, and because they are persons in every sense of the word, they are entitled to apply for a driver's license. For the state to deny undocumented immigrants the opportunity to apply based on a presumption of guilt is un-Constitutional.

Although the states are at liberty to enact laws where appropriate, the 14th Amendment's Equal Protection Clause requires the states to allow all persons in the United States equal access to state laws, having nothing to do with the Tenth Amendment.

The issue has nothing to do with child support or remaining eligible for a driver's license.

The issue concerns being allowed to apply – where the state may not disallow someone from applying simply because it 'thinks' someone 'might' be in the country illegally.

It's possible an undocumented immigrant may not be eligible for a driver's license having nothing to do with his immigration status, which is perfectly appropriate; or an undocumented immigrant may subsequently lose his license for reasons other than his immigration status, the same as everyone else. But the state must at least allow everyone to apply pursuant to the 14th Amendment's Equal Protection Clause.

People who are not citizens... do not enjoy protections of the constitution which governs protections for citizens.

Because that person hasn't been found guilty of entering the country illegally. And when found guilty of entering the country illegally the issue of obtaining a driver's license becomes moot, as they're now subject to being deported. .

The person is therefore guilty of being here, outside the law... thus the person is guilty of being here ILLEGALLY.

Such does not require adjudication, as it is an axiomatic fact.
 
i bet clayton would tell a store owner he is stealing from that he is not taking the candy illegally because a judge hasn't found him guilty
