Florida Sheriff Nicholas Finch Arrested for Doing His Job | The Guardian Express

The residents of Liberty County, Florida heard the news Wednesday that their Sheriff was arrested for doing his job. Sheriff Nicholas Finch, 50, was booked into the Liberty County Jail around 5 pm Tuesday. Florida Governor Rick Scott has named Carl Causey to the post of interim county sheriff. Liberty County is situated in the Florida panhandle, about 40 miles west of the state capital, Tallahassee.

Finch is being charged with official misconduct. He was released from jail on his own recognizance shortly after being booked in.

The charge is related to an incident in March, in which a deputy sheriff arrested a resident of the county for carrying a concealed weapon. Finch made the decision to release the individual shortly afterwards. It is alleged that he then altered or destroyed paperwork relating to the arrest.

One jail worker told investigators that after Hoagland left the jail, Finch arrived with one of Parrish's family members and spoke with Floyd Parrish inside the holding cell. Finch then went into the jail control room, took possession of the arrest file and said Parrish would be released and no charges would be filed, according to court records.

Hoagland told investigators that several days later, he talked with Finch about Parrish's release, and Finch told him he "believed in Second Amendment rights."

Investigators said in court records that Parrish's name was whited-out from the county jail log. While Hoagland was able to provide a copy of Parrish's arrest affidavit, the original arrest record has not been found.

With those facts now known, I am going to say that the Sheriff needed to be arrested.

Not for releasing the man, but for altering and destroying the official paperwork already done.

That is the illegal part and he should have known better.

I would hardly say that qualifies for an arrest, especially when such paper work, even when released or not charged, can be used against you later for gun ownership.

Unfortunately, this time Lakhota is quite correct.

He broke the law when he altered the paperwork.

This is quite impossible. A man who respects the rule of law as much as 2A would NEVER suggest that this Sherriff's actions are acceptable.

Florida Sheriff arrested for ordering the release of a man jailed on gun charges. | Peace . Gold . Liberty

The Feds think they'll get away with this? They better start teaching about Jury Nullification everywhere, now.

The Feds had nothing to do with this. The man was arrested for violating Florida state law and the sheriff decided he could enforce the laws he wanted to enforce and ignore the laws he didn't like. He could also destroy legal documents with impunity. Is that really what you want? Are you arguing that the ends justify the means?

2nd amendment dude; you are a real desperate gun lover aren't you? WTF is the matter with you? Reading or comprehension problem? Seek help. Officers of the law can't just decide to break the law.
Did you know cops take an oath to uphold the law. No matter how they "feel".

The same results could have been achieved while handling this differently.
The sheriff did the right thing the wrong way.
Shoulda placed his deputy on some sort of administrative leave in the process.
Charges can be administratively be dismissed, dropped, whatever, without destroying the documentation.

So the sheriff should have punished his officer for enforcing the law? The sheriff is the arbiter of which laws passed by the state government are to be allowed. An interesting approach.

Where a department places its emphasis is standard in every agency.

Really? So if the IRS should decide to focus its attention on say.... Tea Party 501c's - that is just SOP and of no concern at all. Is that about right?

The site won't let me post links yet but go to Youtube and search "KrisAnne Hall Finch".

Or Google it for her written article.

agreed. he did not brake any law and was acting withing his powers including the destruction of the records.

shame on you, Rick Scott

Sheriff was right state is wrong...2nd amendment is not to be infringed so whatever state law the guy arrested broke was illegal and unethical and unconstitutional. Once again the Sheriff was correct.

Latest update from the Sheriff Finch case:

HUGE CASE UPDATE: Sheriff Finch's first court date was yesterday, neither he or his attorney had to be present as his attorney had already sent in pleading paperwork.....pleading NOT GUILTY. Today the state offered to "defer" all charges on Sheriff Nick Finch....... If he will RESIGN. If you don't know what this means for the State of Florida's case it basically means they have nothing! Despite that they still asked an official elected BY THE PEOPLE to resign from office for something even they know they have no case for.

Sheriff Finch of course told them no way and asked for a jury trial. Trial date is set for October 1st IF it makes it that far. His attorney has filed motions for dismissal and the state can still decide to drop this ridiculous case.

It is important to KEEP CONTACTING the officials in Tallahassee and let them know that enough is ENOUGH!

This man fought for us in Desert Storm and is fighting for us now......help him fight back!
