The better argument is that there is an affirmative duty to invoke the 25th if the President is incapacitated. So if the President falls down the stairs and is rendered brain dead, you argue the VP and the Cabinet are under no obligation to invoke the 25th Amendment to inform the Congress and the American people and affirmatively take control as Acting President.
