So, even if this applied, it can be applied in favor of the Israeli.
However, the High Contracting Parties are all in the Americas. It is a regional treaty. I doesn't apply to the Middle East, Europe, Asia/Pacific or Africa.

Israel has a right to defend itself from Hostile Arab/Palestinian (HoAP) aggression, even if the HoAP does not recognize it.
I've seen HoAP aggressors raise this issue before. It is a case where the HoAP is trying to make the world believe that Palestine was a "state" before the International Community recognized Israel. An alternate history.

Israel's permanent population consisted almost entirely of recent immigrants that it imported for the purpose of populating its planned state.
Israel has never had a defined territory. To this day, Israel has no territory inside defined borders.
Israel is a foreign government inside Palestine. Israel was proclaimed inside Palestine by the foreign Jewish Agency that was created in Zurich by the foreign World Zionist Organization. Of the 37 people who signed Israel's declaration of independence, only one was born in Palestine and he was the son of immigrants. None of them were native to Palestine.
The "state of Israel" was imposed on Palestine by military force.
Israel's Foreign Minister Eban stressed that it was undesirable to undermine what had already been accomplished by the armistice agreements, and maintained that Israel held no territory wrongfully, since her occupation of the areas had been sanctioned by the armistice agreements, as had the occupation of the territory in Palestine held by the Arab states.
