In violation of the equal protection clause of the Constitution, the government is unfairly treating the heaviest cigarette smokers by forcing them to take a disproportionately large burden of the tobacco tax.
Example
Joe smokes 1 pack a day. Joe pays $369 a year in tobacco taxes
Sam smokes 1 cigarette a day. Sam will pay only $18 a year in tobacco taxes!
While Judy - who smokes zero cigarettes a year - gets off TOBACCO TAX FREE!
This is certainly not the "equal protection" our Founders had in mind! We should all be paying the SAME in tobacco taxes, regardless of how much we smoke!
