We know the ACA website has had significant problems with security issues but you have to have permission from the government to sue the government. Will people whose private info falls victim to hackers or to criminal navigators be allowed to sue the government for damages?
 
Not gonna happen. They warn their victims up front that there is NO expectation of privacy when using the site.
 
I believe this was nothing but a government's attempt to collect the data of millions of people, which as we can see clearly today, has failed miserably.

People who put up warning signs can still be sued if they have been negligent.

The government has been negligent -- going online with known security issues -- staying online after more security issues have been found and experts have said the site should be shut down.

Not the government in general. They make the law and in that regard have a LOT of power in that area.

There are not going to be many (if any at all) successful lawsuits against the government over Obamacare.

That sucks so bad -- people are going to be penalized by the IRS for not handing their personal information over to a site which is in such bad shape that experts say it should be closed down. And those who do hand over their information are risking even more serious consequences. That's evil.

This is all covered by the takings clause. Injuries caused by government action require compensation but this is the wrong argument. Anyone who goes on the individual exchange when not subsidy eligible is an idiot. Those who are subsidy eligible are too poor to be injured seriously by the hackers that will hit that site.

The separate business exchanges on the otherhand are a target rich environment where 12-14 figure scores are at least remotely possible
