I don't think Comey is stupid but I do think he is a 10 when it comes to arrogance. I have no doubt that he and Loretta Lynch discussed where they were and the discussion Bill had with her. They didn't dare convene a Grand Jury, regardless of how poorly the case was presented, they'd have handed down an indictment. They couldn't follow proper procedure and hand it over to Lynch, that would have been impossibly obvious.
