It would all depend on contract language.
Very different situations. Mom usually never knows who the Sperm donner is because the donation is processed through a Sperm bank. But you still may be right. The courts will someday decide.Sperm donors are protected so the parents could be likewise protected. And the surrogate could possibly sue for child support.
So...if the couple using a surrogate to have a baby.....if they change their mind, can they force the woman to abort the baby? Even if she will assume the responsibility?
I saw a column at American thinker about the abortion decision....and they mentioned the next step might be ordering surrogates to abort babies.......

While women are often coerced by the men who use them to have abortions it is still illegal in the U.S., unlike China, to force a woman to have an abortion if she doesn’t want one -- though liberals are pushing to change that in surrogacy cases.

Seems like you have your answer. We are consistent. If liberals are consistent, it's the woman's body and they can't make her do anything. If they make her get the abortion they show their hatred for babies.
And a judge could rule the clause not binding because the walfare of the child (once born) supercedes a clause in a contract.Very different situations. That clause could be written in a contract.

Not if she signs on to the contract and it's notarized. It would all depend on contract language.
Actually the contract would become null & void if the female who is pregnant contests it. The 'alternative' would be to physically restrain her & cause a termination of her pregnancy. That will never be allowed to happen.

The baby murder advocates here will justify forcing the surrogate to be sent to those unregulated abortion clinics. where the SCOTUS said unqualified doctors working in unsanitary conditions are allowed to rip the baby from her womb.
You realize that in the world that's considered contract killing, and in every other instance, it's a capitol offense for the people who take out the contract? Not if she signs on to the contract and it's notarized. It would all depend on contract language.

Till the child is handed to the parents it is the property of the surrogate
It's all about the semantics. You realize that in the world that's considered contract killing, and in every other instance, it's a capitol offense for the people who take out the contract? Not if she signs on to the contract and it's notarized. It would all depend on contract language.

Just as no woman should be forced to carry an unwanted pregnancy, no woman should be forced to have an abortion.
Never.
