If she claims in a prepared statement that nothing was going on and then claims the fifth, that's lying to congress, for which she can be held in contempt, and obstruction of justice. If the Republicans were really out to get at the facts they'd have her in jail right now. I don't know what they're up to other than trying to make some kind of show of it. It's clear that the IRS is breaking several privacy laws and abusing their authority. There is evidence that it is being used to destroy people's ability to chose the candidates they want.
Several rights are being breached here, and that is why Lerner plead the 5th.
Freedom from illegal search and seizure.
Freedom of expression
Freedom of thought
Rights to free elections
Protection from discrimination
No punishment without laws

Sorry, you don't have a "privacy" right when you apply to the government and claim to be a Social Welfare Agency when in fact, you are a political organization.
This is what the discussion is about. If you are claiming to be a social welfare agency but you intend to do politics and hide who your donors are- YOU ARE COMMITTING FRAUD!!!
If anything, the IRS went easy on them. They just let them know that they needed to prove they were a social welfare agency (they couldn't) or otherwise told them they didn't qualify.
Oh, Gosh, they actually applied the LAW as written!
