Don Jr.'s ridiculous claim about attorney-client privilege

"Donald Trump Jr. recently told a Congressional committee he could not answer questions about a phone conversation he had with his father, President Donald Trump. Trump Jr. claimed that because attorneys were present on the call he had the right to invoke the attorney-client privilege.

This was not just any father-son chat. Trump Jr. and President Trump were speaking in July 2017, right after his now-infamous meeting in June 2016 became national news. In that 2016 meeting, held at Trump Tower, Trump Jr. allegedly asked a Russian lawyer if they had dirt on Hillary Clinton’s presidential campaign.

But attorney-client privilege is actually much narrower than people, or at least Trump Jr., seems to think.

The privilege was designed to protect certain communications made between the attorney and the client. The point is to allow people to tell their attorneys the real and full story regarding their cases without fear that the information discussed will be disclosed.

However, attorneys are not wizards. Merely having one in the room or on the phone does not automatically make communications subject to the attorney-client privilege."


 
Though Mueller was empowered to investigate Russians? Did not know he was charged with investigating possible sexual peccadillos from over 10 years ago? Next up I guess is looking into how Trump pays his credit card bills?
It wasn't Mueller who got the multiple search warrants. I was the US Attorney's office for the Southern District of New York headed up by a Trump and Company appointee who replaced Prete Bharara last year, or did that slip your grasp? And it's not about one of the Clown's peccadillos but election campaign funds! Get Thee informed!

This does not mean that the Russian investigation is over by a long shot. Mueller can walk and crew gum at the same time

The F.B.I. on Monday raided the office of President Trump’s longtime personal lawyer, Michael D. Cohen, seizing records related to several topics including payments to a pornographic-film actress.

Federal prosecutors in Manhattan obtained the search warrant after receiving a referral from the special counsel, Robert S. Mueller III, according to Mr. Cohen’s lawyer, who called the search “completely inappropriate and unnecessary.” The search does not appear to be directly related to Mr. Mueller’s investigation, but likely resulted from information he had uncovered and gave to prosecutors in New York.

“Today the U.S. Attorney’s Office for the Southern District of New York executed a series of search warrants and seized the privileged communications between my client, Michael Cohen, and his clients,” said Stephen Ryan, his lawyer. “I have been advised by federal prosecutors that the New York action is, in part, a referral by the Office of Special Counsel, Robert Mueller.”

I am no lawyer- and as such I wonder how a search warrant like that gets past lawyer/client privilege.

I would think that the only way to break that privilege would be to allege that the lawyer may have been involved with a criminal conspiracy with his client.
Every scrap is subject to a motion to suppress.

See Cohen is not charged with a criminal conspiracy. No one is. Trump isn't even charged with a criminal conspiracy. A prosecutor does not get to investigate just to investigate and hope they find a criminal conspiracy.

A few observations:
  • Yet again, we see Mueller and the rest of the FBI coming completely "out of the blue" with a bombshell....And people have the temerity to presume they know or can accurately infer the status of Mueller's and other FBI investigations. Nothing could be farther from the truth.
  • Mueller is clearly not seeking to overstep the scope of his mandate. His scope is stuff having Russia as part of its nexus of activity in connection with Trump's 2016 election campaign. Cohen has been adamant about not ever having had a role in Trump's campaign. I suspect, consequently, that the raid does not pertain to the the 2016 campaign, but it may pertain to "conventional" federal election law violations, though it may just be
  • Whatever Mueller turned over to the NY Southern District of the FBI/DoJ must be quite convincing that there's "there" there. That's my observation because Cohen being the POTUS' personal attorney makes the raid fall into a special class of activities within the FBI whereby officials at the highest levels must approve such a raid. All the people at the highest levels of the FBI and DoJ are Trump appointees.
One prediction:
  • Trump is likely apoplectic at the moment and will post a "dipsh*t" tweet about the matter.
