As in the rolling stone article I linked (and I believe there are others that concur with it) that braggs case is thin and even unwinnable.
Federal prosecutors have denied to take up the NDA case, but Bragg felt he could charge it by pinning it to a state misdemeanor in an attempt to upgrade that misdemeanor to a felony in the state of New York.
