A person not properly following the instructions is submitting an invalid ballot.

The article was from October 8th, plenty of time for Indiana to refuse him a ballot if he was breaking the rules.

Anyone can see that he didn't like working with Pres. Trump. But in the way he have told Pres. Trump beforehand that he wasn't going to vote in the favor to have a revote, so that he can go about it in another direction.
In order for Pres, Trump to invoked the insurrection act. He must go through all of the channels, showing that the government was not willing to cooperate with him to investigate this fraudulent election, even though he has mountains of evidence that they didn't wanted to look at.
But Pence knew of this plot to switched the insurrection act back onto Pres. Trump before he can invoked it.
But then, did Pres. Trump has already prepared it right before the riot had started. He could have invoked it due to the riot that he probably had known about the plot. Once he have proof of the plot. That he can invoked it. And once the riot was in affect. That it was the go ahead signal. and he doesn't have to tell anyone until the trouble makers are locked up. And he don't have to go through Congress since they were the violators of the Constitution.
The insurrection act is the President last alternative to use during a government coup on the President and the people's civil rights have been violated. And it is the duty of the President to make sure that the people's constitutional rights are enforced by any means necessary.

Pence is a hero to the religious far right, a political martyr almost for what he did against gay rights in Indiana. he was a brilliant if cynical pick by Trump to be VP.
