Seems ALL muslim's that swear an oath on the Koran are doing so UNCONSTITUTIONALLY, as the Koran, and Sharia is definitely against many things in our Constitution!

New York--New York Judge Carolyn Walker-Diallo, a Black Muslim woman took oath as a civil court judge in New York on Thursday, while swearing to abide by the U.S. Constitution placing her hand on the Holy Quran. In the United States and the majority of Western countries, politicians and members of the courts are sworn in to their positions while placing their hand on the Holy Bible when they take their oath. However, Judge Walker took her oath respecting the sacred book of her Islamic faith, the Holy Quran, while also wearing a hijab. A video posted on Facebook...

A muslim that does not understand their own faith.
An oath does not have to be on any thing or can be on something they hold sacred.
Muslims are only supposed to swear to allah, not on the quran Q 3:77, Sahih Al-Bukhari Hadith 9.9

An oath does not have to be on a bible, it can be raising a hand and simply promising.

Good for her :)

And in other news, after observing the sun appearing to set in the west for the 4,548,445,319th consecutive day a new study suggests it may be a pattern, or in scientific terms a "thing".

Good for her :)
For practicing her faith by following a CHRISTIAN tradition?

For swearing on something that is meaningful to HER. Why do you folks have such a problem with that?

'Umar ibn Al-Khattab (may Allah be pleased with him), that the Prophet (peace be upon him) said: Verily! Allah forbids you to swear by your fathers. If one has to take an oath, they should swear by Allah or else keep silent.' [Al-Bukhari]

'Imam Ahmad related through an authentic chain of narrators on the authority of `Umar ibn Al-Khattab (may Allah be pleased with him) from the Prophet (peace be upon him): "Whoever swears by anything other than Allah has committed Shirk," the author-Anyone who swears by other than Allah has become a Kafir (disbeliever) or Mushrik (one who associates others with Allah in His Divinity or worship) [Ahmad]'

I have a problem with her implementing Sh'ria law in the courtroom. There's a reason swearing on a Bible has been done for centuries, because our legal system is based on Judeo Christian values. When she sentences Mooslim men to probation for honor killing their daughters, it will become more clear to you.

Or maybe not.

Why would a muslim man who killed for honor get probation? He didn't do anything wrong.

A sunni fatwa was issue that if required by the court or face contempt charges a muslim may take an oath on a quran but it don't make the promise to be truthful any more valid. Muslims do not take oaths or make promises on anything but allah. The fatwa was a concession for foreign courts but is meaning less otherwise.

I was not aware of the fatwa. But an oath of office is not under a contempt charge if a muslims does not place their hand on the quran. Basically it is meaning as far is Islam is concerned. Muslims do not swear by the quran, only by Allah, as western christians do in court.

Not sure how the fatwa applies to other sects. Even between legal school of Islam a fatwa is not binding and many contradict each other.

Strictly speaking, an oath should not be taken on the quran or any book by muslims unless forced to.

The issuing of a fatwa is far from muslim or sharia law but more a recommendation by a particular cleric or school. Some believe absolutely in fatwa and other dismiss them.
