The problem here is that treason is by US citizens (or better said, against your own country). It's inherent within the word treason. The Founding Fathers probably didn't think that people who could read would have problems with such things.

Lee lived there for thirty years from 1831 to 1861 when the US govt took it over and made a nice little military cemetery on it, for the purpose of preventing Lee ever going back there. However it wasn't his until 1857 when Custis (his father in law) died.
