Right after the SEC investigates Smith & Wesson they need to investigate Apple, far too many are injured or causing injuries while looking at Iphones. What is Apple doing to prevent this? Then go after McDonalds, Big Macs are making people fat, what is McDonalds doing to prevent this?

PA James Calls on the SEC to Investigate Smith & Wesson for Failure to Disclose Risk

Today, Public Advocate Letitia James called on the Securities and Exchange Commission (SEC) to launch an investigation of whether weapons manufacturer Smith & Wesson (NASDAQ:SWHC) has violated U.S. securities law. In a letter to the SEC, Public Advocate James asserts that Smith & Wesson is failing to disclose material information that would enable its shareholders to assess the risk environment in which the company operates.

“Congress has failed over and over again when it comes to sensible gun control, and we must work around the D.C. dysfunction and take action,” said Public Advocate Letitia James. “We cannot let gun manufacturers get away with hiding the inherent risk associated with their industry. We will continue to do everything in our power to take on the scourge of gun violence and make our City and country a safer place.”

The eight-page letter sent by Public Advocate James to the Enforcement Division of the SEC asserts that the company has a duty to disclose the following material information:

  1. Information about the number of the company’s firearms that are involved each year in crimes;

  2. What steps the company has taken to minimize the risk that the company’s firearms will be used in crimes and mass shooting events; and,

  3. Whether the company has put in place measures that prevent its firearms from being distributed to “bad apple” gun dealerships.

Are they really trying to say that there is an undisclosed risk with firearms?

The Supreme Court addressed this over and over.
 
Perhaps they should do a similar study on which alcoholic beverage, or which brand vehicle, is of most risk in accidents by drunk drivers?
