People were cross-examined and evidence was presented to the jury, and the jury gave their decision. That's what trials are for. You are either dumb or you are struggling to defend your pro abortion position. But I guess the two are intertwined.

To answer your question, it looks at though it was eyewitness testimony which proved the babies were still alive. Can't find any medical proof though.

Former clinic employees testified that Gosnell routinely performed illegal late-term abortions past Pennsylvania's 24-week limit, that he delivered babies who were still moving, whimpering or breathing, and that he and his assistants "snipped" the newborns' spines, as he referred to it.
