It does state that but the Constitution also states the president pro tempore fills in for the president of the Senate in the absence of a VP. And while there are set limitations on a president pro tempore filling in for a VP, such as breaking a tie in the Senate, I'm not aware of any such rule regarding presiding over certifying a presidential election. Even the last president pro tempore said he would have filled in for Pence had Pence not presided over that.

All of this brouhaha is intended to "get to the bottom" of the question of whether President Trump wanted to go to the Capitol and be involved in the "demonstration" on the day in question. So what if he did? He was rightfully pissed off. He loves his supporters. So the fuck what?

I don't think that there is much doubt that he wanted to go to the capital. I'm not sure what law would have forbidden that. The Demofascists are so afraid of Trump in 2026, that they just want to keep throwing mud at him and hope a small percentage of it sticks.

If Cassidy's hokie story is true, that Secret Service dude that told Trump he could not go to the capital should be fired. Can you imagine if General MacArthur had ordered his security detail to take him to a hill in Korea and they told him, "No General, that hill isn't secure?" Trump would have been justified to order his SS men out of the vehicle and driven himself.
