Since the Citizens United court ruling, the IRS has been left to sort out the mess left in it's wake, a mess made even deeper when Karl Rove decided to create CrossroadsAmericaGPS, his super-pac for influencing elections. After the Court ruling, Rove decided he could claim his organization was actually a social welfare organization and claim tax exempt status while shielding the names of his investors. It worked and other super-pac's followed suit.
The problem if that it leaves the IRS in the position of determining just what a social welfare organization is, as opposed to a political organization. That's a role the IRS neither wants nor is equipped to handle.
