Prosecutors determine the severity of the offense and what criminal charges seem appropriate. Typically with honest mistakes jail time isn’t pursued. If criminal intent is shown they penalties tend to be harsher.

So unless they find the Joe lied to or hid documents from authorities then his offense probably won’t be pursued criminally

Having a server is not a crime. She did not destroy the information after it was subpoenaed.

Trump had no authority to have top secret documents in his home either so at a minimum these are equivalent. But it’s far worse for Trump because he defied a grand jury subpoena to return them. Biden had the DoJ come into his homes and search themselves. But the real difference is that Trump clearly and provably knew he had these documents and no such evidence exists for Biden.

Prosecutorial discretion. No question Biden broke the law with the documents he had. Should he be prosecuted and punished when he leaves office? Put in prison for the rest of his life?

If it can be shown he knew he had them, of course he should be. He shouldn't even be allowed to finish his term. He should be impeached and thrown out of office. It's under investigation now so we'll see what happens.

Investigating Burisma is clearly different than investigating Hunter Biden.

Nope, the investigation was into Zlochevsky and it was never pursued. There was no implication of any crimes by any board members regarding Burisma.

Trump voluntarily turned over docs to the Archive. Within weeks of the voluntary return Biden's FBI opened a criminal investigation and his DOJ empaneled a grand jury.
 
A few dozen documents packed among hundreds of thousands isn’t going to get anyone too excited. It happens not infrequently.

He had Nauta take the boxes to his residence where he sorted out classified documents he wanted to keep before his lawyers were able to go through them and turn them over to the DoJ.
