So he should be prosecuted, but not given jail time?Prosecutors determine the severity of the offense and what criminal charges seem appropriate. Typically with honest mistakes jail time isn’t pursued. If criminal intent is shown they penalties tend to be harsher.
So unless they find the Joe lied to or hid documents from authorities then his offense probably won’t be pursued criminally
