Griswold concluding that “Section Three of the Fourteenth Amendment does not apply to Trump.” She ordered Colorado’s Secretary of State Jena Griswold to place his name on Colorado’s presidential primary ballot. This is the fourth state in three weeks to reject efforts to keep Trump off their ballots.

The ruling will be appealed, but the core tenet of the suit with respect to Trump’s instigation of insurrection was confirmed by the judge. The upper court need only rule that the 14th Amendment applies to the president for Trump to be barred from the ballot.

Colorado Supreme Court to take up appeals in Trump ballot case

The appeal is about applicability, NOT whether J6 was an insurrection . That has already been ruled to be the case by the judge and isn’t part of the appeal.
