Oh, I see and who pays for the damage to the truck? The fact that the driver was free and clear of those attackers doesn't mean the driver can instigate retaliation and try to go back to the scene and cause damage without incurring liability for their actions which are deliberate.

The driver can most certainly be held liable for any property damages should the additional damaged vehicle not be the property of the assailant(s).
Free and clear would require assuming what was in front of the vehicle, and out of the camera's view at the point in time when the driver put the car in reverse.

To be specific, you referred to retaliation that would require intent, that you would have to assume at best.

There is no need to pretend that should the driver be in fear of their life, that a strong concerted effort to eliminate the threat,
could be more a matter of efficiency, and not necessarily nefarious intent or retaliation.

There is no need to add or subtract from what information is available, to determine what is obvious to the degree that it is present in the video.

There's no telling where that man was when the driver put the car in reverse.
