As long as there are 10 victims, you can get sentencing enhancements and it goes up from there. There were a lot of people in the dome that day. He might, if convicted, get 6 level enhancements in the guidelines off the 250+ victims box. Really doesn't matter if SCOTUS passed an opinion where judges aren't permitted to 'enhance' charges.....exactly what Merchan appears to have done.
