Actually, I didn't see any reference to incite violence, just flag burning which is allowed under our freedom of speech laws. As reprehensible as it is, especially at a national cemetery. I am reminded somewhat of the those Westboro? Baptist Church people that used to protest when a fallen US member was laid to rest, which I thought was despicable but legal if they obeyed restrictions and limitations of the local LEs. That cemetary includes thousands who died to free the slaves, let them rest in peace. Burning the flag does not honor them, in fact they fought and died to keep this country united. And anyone who has a problem with that can go to hell.

To answer your question, I doubt that the riot has to happen to be an arrestable offense, the Supreme Court seems to be somewhat lenient on that in favor of our freedom of speech. But if you incite imminent and specific unlawful activity that is deemed to be likely to occur then your freedom of speech doesn't cover that. In this case the hoaxer didn't do anything illegal IMHO.

One more point: Antifa has a reputation for violence, and any reference to their possible appearance ought to be considered a realistic threat to the people and property wherever it is. This time people showed up to defend that sacred ground, and some would laugh at them for being fooled. Haha, very funny.

What this episode really illustrates is that a sleeping giant is waking up. For decades, those on the left have been accustomed to the luxury of being complete idiots, destroying things and hurting people with little to no push back. It used to be that they could gather in large numbers, do their thing and melt away, leaving destruction behind and no one stood against them. Heck, even the police were/are ordered to stand down. I've seen write ups saying the protests were "peaceful until later in the day," or "peaceful for the most part," or that fighting broke out at times, but this video is Breitbart-worthy twisting of the truth. Not a single announcer or article is describing that violence as "peaceful." All that is doing is emphasizing the worst of what happened, accusing people of calling it peaceful with no evidence that they did. What I am saying is they did not have major organized role in them. From what I read, the forces behind the violence varied from locale to locale, most of it spontaneous and opportunistic. In some cases Antifa and some cases white supremacists. I flat out do not trust Barr, who imo, does the bidding of Trump.

When it comes to violence in riots...there is often a tipping point where a mob mentality takes over. That is pretty well documented. There are also documented incidences of instigators attempting to turn peaceful protests violent. Both white supremacists and Antifa have been implicated there. Where I disagree with you is the impression that there is some sort of master plan orchestrating this.

Actually, I didn't see any reference to incite violence, just flag burning which is allowed under our freedom of speech laws. As reprehensible as it is, especially at a national cemetery. I am reminded somewhat of the those Westboro? Baptist Church people that used to protest when a fallen US member was laid to rest, which I thought was despicable but legal if they obeyed restrictions and limitations of the local LEs. That cemetary includes thousands who died to free the slaves, let them rest in peace. Burning the flag does not honor them, in fact they fought and died to keep this country united. And anyone who has a problem with that can go to hell.

To answer your question, I doubt that the riot has to happen to be an arrestable offense, the Supreme Court seems to be somewhat lenient on that in favor of our freedom of speech. But if you incite imminent and specific unlawful activity that is deemed to be likely to occur then your freedom of speech doesn't cover that. In this case the hoaxer didn't do anything illegal IMHO.

One more point: Antifa has a reputation for violence, and any reference to their possible appearance ought to be considered a realistic threat to the people and property wherever it is. This time people showed up to defend that sacred ground, and some would laugh at them for being fooled. Haha, very funny.

When it comes to violence in riots...there is often a tipping point where a mob mentality takes over. That is pretty well documented. There are also documented incidences of instigators attempting to turn peaceful protests violent. Both white supremacists and Antifa have been implicated there.
