A high school social studies teacher in Batavia, Illinois, faces disciplinary action for informing students of their Fifth Amendment rights in connection with a survey asking about illegal drug use. Punishing the teacher after he had taught the students about their rights, will make it very clear to this generation of high schoolers that they no longer have them.

Wouldnt want any of our upcoming youth to believe that they are free.
 
This is fucked up. The school would be (well, should be) open to lawsuits for this shit. They shouldn't even ask kids any questions without parents or maybe a lawyer present. What the hell do they think they're doing here? I realize that some think that teachers and government should have the right to take over for parents as they see fit, but until they completely shred the constitution and bill of rights, they better back off. It's the school officials that need to be suspended.

Reminds me of my school during Viet Nam. The Administration, not the teachers, didn't want us to realize our rights.
 
As noted by others..

1 - That paper should not have asked for any identifying answers.

2 - The Teacher was right in doing what they did.

3 - The School Admin was negligent in not preparing the Teachers for this survey properly so that they could have time to ask questions.

4 - If punished, I hope they sue.

I don't remember the Administrators at my school who pulled this kind of stuff being liberals. I grew up in a big time conservative area.

I don't remember the Administrators at my school who pulled this kind of stuff being liberals. I grew up in a big time conservative area.

And I grew up in the Chicago Union and burb school system. I know how are they are up there. Batavia used to be conservative in the 60's, now it became dominated by liberals on the west side that corridor exploded in the past 20 years and went to hell....

Idk.... I swear the left wants to tramble are rights and it seems the right goes along with it because they dont want the kids today to have a bit of a teen age experience like they did....

But board members said the questionnaire was developed as a way to detect kids at risk of harming themselves and was prompted by a rash of suicides. They further stressed that there was no intent to punish students who reported using drugs or alcohol.

"The issue before the board tonight was whether one employee has the right to mischaracterize the efforts of our teachers, counselors, social workers and others, and tell our students, in effect, that the adults are not here to help, but that they are trying to get you to 'incriminate' yourselves," Superintendent Jack Barshinger stated in a letter to the Batavia community.

After two hours of closed session discussion, the board voted on Tuesday night to put an official "letter of remedy" on Dryden's file for what was termed "improper conduct." Newly elected member Jon Gaspar was the sole "no" vote to the decision.

Moreover, pubic sector employees do not enjoy First Amendment free speech protection concerning statements pursuant to their official duties, which is clearly the case here. See: Garcetti v. Ceballos (2006).

The Garcetti Court was clear that public sector employee can indeed be subject to punitive measures for speech made in an official capacity as a legitimate aspect of a job performance evaluation. It would be pointless for the teacher to file suit accordingly.

and you know what is so funny? what happend to the middle class liberals living there? they ran to places like Arizona. Just last year I was in living in the Phoenix area for 6 months and my liberal friend and her husband from my youth were bitching about the "RiCH" taxing them out of thier home in West Dunde Illinois They coulndt figure it out the Fucking democrats of Illinois is what screwed them over.
