Then, Smith will have to proceed to trial unless Trump appeals that decision. At that point, frankly, it still isn’t clear that the SCOTUS would accept the appeal.

So what? The case may at that point be ready to proceed. If Trump then does go to trial and losses, his appellate issue will be fully preserved for the trial appeals.
