The contract did include a clause that specified the surrogate would agree to terminate if the fetus was found to have 'severe abnormalities'. Legally, technically -this was insufficient because the type of abnormalities wasn't specific enough.

She would have agreed to an abortion for $15,000.

The child's condition is more severe than originally thought. She is facing several more surgeries and specialists give her less 25% chance that she can ever live any semblance of a normal life. Her internal organs are not in the correct places and her brain didn't form hemispheres, irc.

And she is in foster care. I don't have much respect or empathy for the surrogate.

She entered into a contractual agreement with the couple who paid her.

If not legally then it seems morally they should have had some input into the decision. It was their embryo.

It doesn't sound like she will be able to repay the money. She has 2 children and her only income is child support from one of the fathers. The surrogacy was a means of generating income.

The infant possibly will not survive the numerous surgeries and I assume the cost for the medical care is now in the $10'000's--quite an ethical dilemma.

The money is secondary to what this child will endure and then not really have any sort of chance at life.

Greater minds than mine can perhaps make better sense of this. In such a situation I would have chosen differently.
