Gov. Greg Abbott appealed for out-of-state help to fight the third wave of COVID-19 in Texas while two more of the state's largest school districts announced mask mandates in defiance of the governor.

Abbott's request Monday came as a county-owned hospital in Houston raised tents to accommodate their COVID-19 overflow. Private hospitals in the county already were requiring their staff to be vaccinated against the coronavirus.

Meantime, the Dallas and Austin school districts announced Monday that they would require students and staff to wear face masks.

The Houston school district already announced a mask mandate for its students and staff later this week if its board approves.

The highly contagious delta variant is fueling the wave.

is the difference between citizen enforcement of laws and the rule of law by public agency. So disappointed that the 9 chose to not hear the Texas case. Roberts was not happy. Each dissenter felt strongly enough to write their own opinions.

Texans can now not only open carry but they can also empower citizen arrests in abortion judgement calls. I would not want to be a woman living in Texas and I am shocked that the Supreme Court is going to allow this to stand. I don't see how the lower courts will allow the abortion ruling stand either but that will take time.

The four dissenters — Chief Justice John Roberts and Justices Stephen Breyer, Sonia Sotomayor, and Elena Kagan — argued in separate rebuttals that their five colleagues, without any real debate, were rewarding Texas lawmakers for inventing a novel scheme to stomp on decades of Supreme Court precedent.

"The statutory scheme before the Court is not only unusual, but unprecedented," Roberts wrote, and he would have granted "preliminary relief" at least until "the courts may consider whether a state can avoid responsibility for its laws in such a manner." Instead, the court allowed the law to take effect before lower courts weighed in, "without ordinary merits briefing, and without oral argument."

Sotomayor was more direct, calling the court's decision "stunning" and saying the five-justice majority "opted to bury their heads in the sand" while Texas "flouts nearly 50 years of federal precedents" by "outsourcing the enforcement of unconstitutional laws to its citizenry." Essentially, "the Texas Legislature has deputized the state's citizens as bounty hunters, offering them cash prizes for civilly prosecuting their neighbors' medical procedures," she wrote, and the court is rewarding this "breathtaking act of defiance — of the Constitution, of this court's precedents, and of the rights of women seeking abortions throughout Texas."

Breyer wrote that he doesn't see how Texas' enforcement-delegation scheme "should make a critical difference," since it still "threatens to invade a constitutional right."

Kagan said the court should not have greenlighted a "patently unconstitutional law" with barely any discussion and "less than 72 hours' thought." The five justices gave only "cursory" review to the submitted documents, and "barely bothers to explain its conclusion — that a challenge to an obviously unconstitutional abortion regulation backed by a wholly unprecedented enforcement scheme is unlikely to prevail," she added. "In all these ways, the majority's decision is emblematic of too much of this court's shadow-docket decisionmaking — which every day becomes more unreasoned, inconsistent, and impossible to defend." A once proud state is shambles and is a shell of its former self. The right wing nuts in Texas are virtue signaling themselves to death. Literally 111 people died in the winter storm because Texas wants to sell its soul to the right. But recently it’s been even worse. More infrastructure problems in electricity, healthcare nightmares, flood management problems and the list goes on. Instead of fixing problems the states leaders are in Cancun, or on TV or fighting fake culture wars. Anything but running the state of Texas.

To borrow a phrase from the great statesman Donald F Trump “Sadddd”.

  8. Fighting racial imbalances of a skewed justice system that has nearly 80% of death row inmates

Texas is blessed because we took the initiative on stopping the murders of the unborn American human beings that depend on their mothers to love and nurture them, not conspire with greedy people to first threaten them, which they resist, then hurt them, proven by enzyme tests, and then kill them dead, proven by the vultures waiting to take their body's gifts and make some big bucks out of the little child's misery, pain, and uncelebrated death.
