It means that they don't have a case for 1st or 2nd degree murder by any stretch of the imagination and the judge is trying to give the prosecution something anything to try to get Chauvin on. This is prosecutorial abuse---Floyd died from his drug abause--but they gotta get Chauvin on something after all the riots and going after him like they have.

If they want something to get Chauvin on they might try littering.

Communists don't think. If the medical report really said that neck compression was the primary cause of death there would be no reason to resurrect the 3rd degree murder charge. After all it was one of the original charges and dismissed by the Judge when he thought he had a sold murder case. After a review of the evidence including the ME report the judge determined that he needed a lesser charge. Perhaps the judge just didn't believe the report and had credible rebuttable evidence. Likely it was that the overdose was the primary cause of death and the judge is trying to keep the case alive.
