This statute requires that the person not only be in possession of the material, but that they person believes the material is to be used for injury to the US. No one, even Trump haters with a brain, would think that Trump was going to use the material to cause damage to the United States. What was Trump planning to do, sell nuclear secrets to Kim Jong Un in exchange for billions of dollars? Release the rcords to the NYT to damage the reputation of the US? Doesn't seem credible

But there is more to the law, that could relate to his situation.

This was SCIF TOP SECRET stuff that he let aids pack up, who did not have clearance.

And he refused to return it when asked

And he was negligent.

So, its possible he could still be in trouble??? The devil is in the details....

Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer—
Shall be fined under this title or imprisoned not more than ten years, or both

The reporting is that Trump’s lawyers claimed that they had turned it all over and they clearly hadn’t.

Seriously you, I, nobody else knows what they found, what they took, what they were looking for. The President has full authority to declassify ANYTHING he wishes to declassify. Merrick Garland's statement was so idiotic and unbelievable that nobody with a brain could believe he was telling the truth. His body language demonstrated discomfort as well.

There was NO REASON not to allow his lawyer and other witnesses to be present during the search to demonstrate the FBI was on the up and up.

It is entirely credible to believe this was malicious and politically motivated. The timing, the way it was done, and the selective 'suggestions' to a fully leftwing compliant media have hoax written all over it.

Here's just one of the numerous lies your story tells:

The judge is hardly "neutral." He's an Obama crony who has donated thousands of dollars to Obama. HE also previously recused himself from a Trump case because he said he couldn't be objective about it.

Just an observation.
It's beginning to look like MSNBC has government operatives employed so that the important questions will be asked.

This thing if now in full bloom by the FBI obviously attempting to make a very big sideshow out of the documents Trump was sitting on. The ultimate accusations of there being national security damage already have been done. Trump may have already passed on much of the top secret information to one of America's enemies.

Or at least saving the documents as insurance against the FBI/CIA/DOJ taking action against him.

The authorities are obviously appreciating the severity of the possibilities, and it's make obvious to them by Trump's openly mannerisms of not having any real concerns for government's security concerns.

In other words, the FBI is intent on a *clean kill while it's still possible.

*figuratively.
