LOL. Of course it would be negligence because if you are mopping a floor in a public area and don't put down a wet floor sign, you would be negligent if someone slipped and got hurt or even died and I'm sure that that has happened a number of times. That doesn't mean you put the negligent person in jail for the death. That's why there are civil courts to sue who the janitor worked for, for having a negligent janitor. But, no one goes to jail for it. Not the janitor and not the janitor's superiors. It's a civil issue for the janitor's employer, not the janitor themself.
