It shoulda only been a statutory rape case. The 14yo 'hooked up' via 'find sex' app so claiming involuntary anything is nonsense. If the man (who knew his HIV status taking meds for it) had unprotected sex, that should be pursued as a seperate charge. Thinking on that aspect, if you know having sex without condoms makes it likely you'll transmit the virus into your partner, doing so is reckless disregard for them. Though we don't do that for other conditions as the article mentions, I think it's only because it's never come up before. With some of the current strains of flu killing off healthy adults, I think it's plausible it could come up though. Asian cultures care about not infected their fellows wering masks when they have a cold, but it's how their culture is. Our culture is much more apahetic so I'd think our reluctance to prosecute disease-spreaders who do so knowingly is a reflection of this culture.

When it comes to having sex with minors, the standard is one of 'strict liability.' That means that if she is a minor it doesn't matter if she showed you a birth certificate saying she was of age, you will still be prosecuted. What the minor does or says about their age is immaterial when the standard is strict liability.
