He throws the cup in the trash. The donut with his DNA on it (evidence). He disposes of that too by swallowing it. We're talking about recordings that have been produced or discovered by investigators that shows evidence of wrong-doing.

Evidence is something or anything that shows proof of something.
It doesn't have to be filed or entered into court docs to be called evidence.
It can be called direct testimony which is evidence or hearsay evidence.
It doesn't have to be something that a clerk or a lawyer put under seal or documented.

Clearly you cocksuckers want to change the fucking meaning of words to get a desired outcome.
It has to be the subject of an investigation (or likely investigation) or under some other legal sanction against tampering with or destroying it. Example, a company that routinely reuses surveillance media.

I know what mens rea means. It's one of the first God Damned definitions you learn in Paralegal school.
And when it comes to criminal intent, attempting to dispose of or destroy evidence is mens rea.

For example, trying to switch places with a drunk who was driving shows criminal intent after an officer stops them for speeding.
The very act or the attempt shows criminal intent.

Yet switching places with a driver, who was the getaway driver for a bank robbery the previous day (that you weren't part of) is perfectly legal.

The difference that sticks out more than anything, is that this corrupt DOJ is bringing charges against a president for what he had full authority to do, but choosing not to bring charges against someone who didn't have that authority. And to top it off they're using a lame excuse at that.

From all of my training it doesn't matter if you're a forgetful asshole who neglected to protect classified material. Being incompetent and careless has never been a valid excuse before now.

Trump is unfit for the job. Trump is charged with crimes for refusing to cooperate with the recovery of classified documents to their rightful owner, The National Archives.
Biden is not being charged because he wilfully returned the items.

Actually that is a derivative right, because the material was derivative, and not an original source. It contained no classification markings. They were his personal notes. And although they should not have contained classified material, they never the less did.
