So, are they going to take this money and return it to the banks? If he owes back taxes and fines, that’s one thing, but doubtful those equate to over 400 million, so if this judgement is on behalf of the banks..then should they money go to them? Instead, the state of New York gets to keep it, because they sued trump on behalf of banks who didn’t request a lawsuit and were not defrauded? (They agreed to the terms of the loans).

Not Timbs was not a Civil Case, it was a criminal case. The SCOTUS decision in the case involved a criminal case and civil forgeture unter a criminal system.

It had nothing to do with a Civil Case of disgorgement. Disgorgement being the removal of illegally obtained assets in New York for persistent fraudulent and illegal business activites.

There are also other claims. 1st he was never convicted of any criminal fraud, and this particular law has never been used on someone not convicted of such a crime. 2nd, the judge didn't even hold a trial, just gave a summary judgement and proceeded right to the penalty phase.

The State is not a defrauded investor.

You and the State can call it whatever you want- a PB&J sandwich for all I care. Sotomayor's language is clear. If it's a "disgorgement", it's an equitable remedy and it has to be paid to the victims.

Otherwise it is a punitive sanction (a fine), which puts it squarely in the realm of the 8th and 14th amendment prohibitions.

This case is begging for SCOTUS review, and they've been looking for a case to clarify this issue beyond Kokesh and Liu. I think this could be the one...
 
The eighth amendment to the constitution forbids excessive fines and forfeitures in civil cases. The SCOTUS already ruled (9-0) on this in Timbs vs Indiana (2019). The state cannot assess excessive fines.
