It should be but the politicians and judges are cowards. It is a tax on a Constitutional right and as bad as when the Government had a pole tax to keep Black people from voting.

Biden's BATFE recent change in the rule for pistol braces has opened up the NFA to judicial scrutiny.
There's not a thing in the NFA34 that can be demonstrated as consistent with this Nation’s historical tradition of firearm regulation.
And while the initial issue revolves around SBRs, it could ALL go.
